SEC & DOJ Await India's Response to Adani Notices

According to a status report of the case filed in a New York court, ‘The US Securities and Exchange Commission (SEC) and the Department of Justice (DOJ) are awaiting India's response to a request seeking assistance to serve notices on Gautam Adani and Sagar Adani in a securities fraud and bribery case.’

In February, the SEC required help from India’s Ministry of Law & Justice to serve ‘Notices of Lawsuit’ (notified the parties about filling of the lawsuit) and ‘Requests for Waiver of Service of Summons’ (requesting the defendants to voluntarily receive legal documents) on the Adani Group chairperson and his nephew. The assistance was required under The Hague Service Convention, and enables legal cooperation in cross-border cases.

Relevant judicial authorities in India to attempt to be served by the ministry have ‘confirmed’ receiving the request and directed it to them.

Christopher M Colorado stated on April 25 that the SEC required additional updates from the India MoLJ concerning it, but no response has been updated so far, which was also reviewed by ET. During the press meeting on Saturday, the request for comment was not responded to by the Ministry of Law & Justice. 

Magistrate Judge James cho, stated, “The SEC counsel has identified the counsel representing Gautam Adani and sent ‘Notice of Lawsuit’ and’ Request for Waiver of service of Summons’ to the counsel.”  It has mentioned that neither defendant has agreed to waive service of the summons and complaint till the date.
